1. Agreement to Terms
By accessing or using Magic Image ("Service"), operated at magicimage.co and available as a Figma plugin, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Magic Image is an AI-powered image generation service that allows users to create images from text prompts (text-to-image) and transform existing images (image-to-image). The Service is available through our web application and as a Figma plugin.
3. Account Registration
To use the Service, you must sign in with a Google account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information during registration.
4. Usage and Credits
The Service operates on a credit-based system. Each image generation consumes credits according to your plan. Free plan users receive a limited number of credits. Paid plans offer additional credits and features.
Credits are non-transferable and non-refundable unless otherwise stated. Unused credits may expire according to the terms of your plan.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Generate content that infringes on any third party's intellectual property rights
- Generate content depicting minors in inappropriate situations
- Attempt to reverse-engineer, decompile, or extract the AI models used by the Service
- Use automated systems or bots to access the Service beyond normal usage
- Circumvent any usage limits or access controls
6. Generated Content
You retain ownership of the prompts you submit. Subject to these Terms, you are granted a license to use the images generated through the Service for personal and commercial purposes.
We do not guarantee that generated content will be unique or that it will not resemble content created by other users or existing works. You are solely responsible for ensuring your use of generated content complies with applicable laws.
7. Payments and Subscriptions
Paid plans are billed through our payment processor, Paddle. By subscribing to a paid plan, you agree to Paddle's terms of service in addition to these Terms.
Subscriptions automatically renew unless canceled before the end of the current billing period. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.
8. Refund Policy
We offer a 14-day refund policy. You may request a full refund within 14 days of your initial subscription purchase or any renewal payment, provided the request is made within that window.
To request a refund, please contact us at hi@magicimage.co with your account email and the reason for your request. Refunds are processed through Paddle in accordance with Paddle's Buyer Terms.
Credits consumed during the refunded period will be deducted from the refund where applicable. Free plan credits are not eligible for refunds. After the 14-day window, subscriptions are non-refundable, but you may cancel at any time to prevent future charges.
9. Figma Plugin
The Figma plugin is subject to Figma's terms of use in addition to these Terms. The plugin communicates with our servers to generate images and requires an active Magic Image account.
10. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
11. Limitation of Liability
To the maximum extent permitted by law, Magic Image shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of data, profits, or business opportunities.
12. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the new Terms.
